  1. Sponsor/Administrator: The Sweepstakes is sponsored by R2Net Inc., DBA James Allen, a Delaware company with its principal business address at 135 W 50th St, New York, NY 10020 (the "Sponsor"). The Administrator is Don Jagoda Associates, Inc., 100 Marcus Drive, Melville, NY 11747 ("Administrator").
  2. Sweepstakes Period: James Allen Glitz & Gridiron Sweepstakes ("Sweepstakes") begins at 12:00 a.m. Eastern Time ("ET") on January 1, 2024 and ends at 11:59 p.m. ET on January 21, 2024 ("Sweepstakes Period"). Administrator's clock shall be the official clock of the Sweepstakes. All Entries must be received during the Sweepstakes Period to be valid, eligible, and compliant with these Official Rules to be entered into the Sweepstakes.
  3. Eligibility: The Sweepstakes is open to legal residents of the fifty (50) United States (including the District of Columbia) who are eighteen (18) years of age or older as of date of entry ("Entrant"). Employees, officers, directors of Sponsor and Administrator, and each of their respective parent companies, affiliates, subsidiaries, retailers, advertising and promotion agencies and judging organizations, or any other entities engaged in the development, distribution, implementation of the Sweepstakes, including third-party fulfillment agencies and all local sponsors (collectively with Sponsor and Administrator, the "Released Parties"), as well as their immediate family members (spouses, parents, children and siblings and their spouses) regardless of where they live, and/or persons living under the same household (whether or not related) are not eligible to enter or win. This Sweepstakes shall be construed and evaluated solely according to United States law and subject to federal, state and local laws and regulations. Void in Puerto Rico, all US territories and possessions and where prohibited. By entering, Entrants acknowledge compliance with these Official Rules, including eligibility requirements. Sponsor and /or Administrator reserves the right to verify eligibility at any time.
  4. Two (2) Ways to Enter: (1) Online/Call-In Purchase Required: During the Sweepstakes Period, eligible Entrants may receive one (1) entry into the Sweepstakes by: (1) visiting www.jamesallen.com (the "Website") (directly or through a link sent when you Call-In for purchase); (2) making a purchase of one (1) complete engagement ring including the setting and center stone, valued at one thousand dollars ($1,000) or greater; and (3) agreeing to opt-in to James Allen marketing communications during the checkout process. All online purchases will automatically be entered into the Sweepstakes ("Online Entry"). All online purchases must be paid by 11:59 p.m. ET on January 21, 2024 or the Online Entry will be disqualified.

    NOTE: You may opt out of marketing messages at any time. Opting out will not affect your odds of winning a prize. In order to access the Website and in an effort to optimize the Website's user experience, ad-blocking software on your computer may need to be disabled.

    (2) No Purchase Required: Alternatively, eligible Entrants may receive one (1) entry into the Sweepstakes with no purchase required via U.S. Mail. During the Sweepstakes Period, on a plain piece of 3” x 5” paper, hand print your complete name, street address (no P.O. Boxes), city, state, zip code, date of birth (mm/dd/yyyy), telephone number and valid email address. Mail your entry in a hand-addressed, business-size (#10) envelope with first-class postage affixed, to: James Allen® Glitz & Gridiron Sweepstakes, P.O. Box 7703, Melville, NY 11775-7703 ("Mailed Entry"). All Mailed Entries must be postmarked by January 21, 2024 and received by January 29, 2024 to be included in the Grand Prize drawing. Collectively, all Online Entries and Mailed Entries will collectively be referred to as "Entries" or an "Entry" as appropriate. Limit one (1) Entry per person/email address regardless of method of Entry. The email address associated with the person submitting the Entry will be deemed the Entrant to whom the prize will be awarded if determined a winner.
  5. Entry Submission/Requirements: Any use of robotic, repetitive, automatic, programmed, or similar automated Entries (including but not limited to, sweepstakes or entry services), regardless of method of submission, are prohibited, and any use of such automated devices will cause disqualification. All Entries must be complete to be eligible. Duplicate or multiple Entries from the same person/email address of the same person using different email addresses, identities, registrations, logins, or any other methods are not permitted and will be automatically eliminated from the Sweepstakes. Incomplete, incorrect, corrupted, or untimely entries are void and will be disqualified from the Sweepstakes. By entering, you understand that all Entries in their entirety or any portion of thereof become the property of Sponsor and will not be returned, and Sponsor will not verify receipt of Entries. Entries may (in Sponsor's sole discretion) be posted on the Sponsor's websites and /or used in other Sponsor-selected media. If you are entering the Sweepstakes from a mobile device, you may be required to turn on location services on your mobile device. Normal Internet and/or mobile device access and usage charges imposed by Entrants' online and/or mobile service will apply and are the Entrants' sole responsibility. By making a purchase during the Sweepstakes Period, you also are confirming that you have read the Privacy Policy: https://www.jamesallen.com/privacy-policy/ and agree that your email and the provided information will be collected and used by James Allen for the purposes of sending news, promotions and updates via email. You can withdraw your consent at any time by unsubscribing or contacting service@jamesallen.com. Opting out will not affect your odds of winning a prize. Sponsor is not responsible for lost, late, misdirected, corrupted, incomplete or damaged Entries. Proof of submission is not proof of receipt by Sponsor and/or Administrator.

    All Entries must be in English and must comply with these Official Rules and the registration instructions, as determined in Sponsor's/Administrator's sole discretion, to be eligible.
  6. Winner Determination: On or about February 1, 2024, one (1) Grand Prize winner will be randomly selected from among all eligible Entries received/postmarked during the Sweepstakes Period. The random drawing will be conducted by the Administrator, an independent judging organization whose decisions are final on all matters relating to this Sweepstakes. Odds of winning the Grand Prize depend on the total number of eligible Entries received/postmarked during the Sweepstakes Period.
  7. Winner Notification: On or about February 2, 2024 the potential Grand Prize winner will be contacted via email and phone and will be required to execute and return, via email, a completed and signed W9 form, Declaration of Eligibility, and Liability/Publicity Release (where legal) within 24 hours of notification. If the potential Grand Prize winner notification is returned as non-deliverable, the potential Grand Prize winner or their guest is not available to use the Grand Prize between February 9, 2024 and February 12, 2024, or if the potential Grand Prize winner fails to return the required verification documents from his/herself or respond within the required time frame, said Entrant will be disqualified. If the potential Grand Prize winner is found to be ineligible or if they do not comply with the Official Rules, said Entrant will be disqualified. If an Entrant is disqualified for one of the reasons mentioned above, an alternate potential Grand Prize winner may be selected in the same manner for the winner as described above, time permitting. Acceptance of Grand Prize constitutes permission for Released Parties to use Grand Prize winner's name (and their guest), Entry, statements, biographical information, voice, state of residence, photograph, and likeness for promotional purposes in any and all media (including on Sponsor's e-commerce website) throughout the world in perpetuity without further compensation or consideration, notification, review or permission, except where prohibited by law. By submitting an Entry, Entrants agree not to instigate, support, maintain or authorize any action, claim or lawsuit against the Sponsor on the grounds that any use of their Entry infringes any of the Entrant's rights as the creator of the Entry, including without limitation, copyrights, trademark rights, and moral rights. Sponsor and its designees shall have the right to edit, publish and use the Entries in any way and in any media for trade, advertising, promotional, and/or other purposes as Sponsor and/or its designees may determine. Sponsor reserves the right to conduct a background check on the Grand Prize winner (and their guest) and reserves the right in its sole discretion to disqualify any Entrant based on the results of such background check, if Sponsor determines in its sole discretion that awarding the prize to such Entrant might reflect negatively on Sponsor.
  8. Grand Prize and Approximate Retail Value (“ARV”): One (1) Grand Prize winner will receive two (2) admission tickets (the “Tickets”) to attend a professional football game at Allegiant Stadium in Las Vegas, NV on February 11, 2024; prize package also includes: three (3) hotel nights' accommodations (February 9, 2024 through February 12, 2024) (single room, double occupancy) at a Sponsor designated hotel; open-air pre-game party, entrance to the official campus, tailgate, live music entertainment, photo ops, access to VIP restrooms, one (1) e-check valued at one thousand, seven hundred dollars ($1,700) to be used towards purchasing air transportation (collectively, the “Grand Prize”); Grand Prize ARV: $24,595.

    The resale or auction of the Grand Prize is expressly prohibited. The Tickets may have separate terms and conditions, and Allegiant Stadium may have its own protocols, policies, and procedures. Grand Prize winner and guest must comply with all such terms and conditions and requirements. Failure of the Grand Prize winner and/ or guest to comply with those terms and conditions, protocols, policies, and procedures could result in a forfeiture of the Tickets without any additional compensation.

    The Grand Prize winner is solely responsible for all taxes in connection with the prize, including without limitation federal, state and local taxes, and the reporting consequences thereof. Grand Prize must be used on dates specified or the Grand Prize will be forfeited. Seat assignments at game are Sponsor-specified. The Grand Prize winner will be issued a 1099 tax form for the actual value of Grand Prize. Grand Prize winner is solely responsible for any and all expenses not expressly stated in the Grand Prize description herein, including but not limited to, ground transportation, air transportation, in-room hotel charges (e.g., mini-bar, room service, telephone, movies, etc.), meals, beverages, gratuities, gasoline, parking, tolls, souvenirs, insurance, travel upgrades, baggage fees, and personal incidentals. Grand Prize winner will be required to provide a valid credit card at the time of hotel check-in and will be solely responsible for any and all charges to winner's hotel room during his/her stay. In the event the Grand Prize winner cannot use the Grand Prize on the dates designated by Sponsor, or if Grand Prize winner or their guest is not legally eligible for travel to the destination, then the Grand Prize winner will be disqualified, and the Grand Prize will be awarded to an alternate Entrant provided sufficient time remains prior to the designated date of the Grand Prize. Grand Prize winner may extend their stay in Las Vegas, NV at their own expense. Grand Prize winner's guest (or Grand Prize winner on behalf of minor guest) must execute a release of liability prior to use of prize. Grand Prize winner and guest will be solely responsible for obtaining a valid U.S. Government issued identification (including a valid US Passport) prior to travel and any associated costs for these requirements. In the event the Grand Prize winner or his/her/their guest is 21 years of age or older and consume alcoholic beverages while participating in any Grand Prize related activities, they do so at their own discretion and agree to hold Released Parties harmless from and indemnify for any subsequent damages or third-party claims arising out of or related to such consumption. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations to passengers, such as changes in services or accommodations necessitated by same. Sponsor shall not be liable for any loss or damage to baggage or other items. All travel is subject to any and all restrictions instituted by the CDC and/or Department of Homeland Security, as required and if borders are closed or the game is cancelled or postponed due to COVID/any pandemic, Sponsor is not responsible and may substitute a prize of equal or greater value, in its sole discretion. Sponsor reserves the right, in its sole discretion, to substitute a prize (or portion of prize) with one of comparable or greater value should the Grand Prize become unavailable for any reason. Sponsor shall not have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with any prize provided pursuant to the Sweepstakes and/or any person's participation in the Sweepstakes. Grand Prize (or any portion of the Grand Prize) is awarded on an “as is” basis and is nontransferable, non-assignable, and no substitution or cash redemption is allowed, except that Sponsor reserves the right to award a prize of equal or greater value if the advertised Grand Prize is unavailable. In the event the Grand Prize winner and/or guest engages in behavior during travel/at game that (as determined by Sponsor in its sole discretion) is obnoxious or threatening, illegal, or that is intended to annoy, abuse, threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor, or any of Sponsor's services, products, trademarks, service marks, or logos, Sponsor reserves the right to terminate their travel early, eject them from the game and send the Grand Prize winner and guest home with no obligations or compensation to Grand Prize winner.
  9. General Rules: By participating in this Sweepstakes, each Entrant agrees to be bound by these Official Rules and by all decisions of the Released Parties, which are final and legally binding in all matters relating to this Sweepstakes. By participating, Entrants and winner agree to release, discharge, indemnify and hold harmless the Released Parties from and against any claims, damages, or liability due to any damages, or losses or injuries to any person (including death) or property of any kind resulting, in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes. Entrants further agree not to pursue any right, claim or action against the Released Parties in connection with their participation in this Sweepstakes. In the event of a dispute as to the identity of an Entrant, the authorized account holder of the email used to enter will be deemed to be the Entrant. An “authorized account holder” of an email address is the natural person in whose name the email address has been issued by the Internet Access provider or on-line service provider. Sponsor is not responsible for lost, late, or misdirected Entries, technical hardware/software failures of any kind, lost/unavailable network connections, or failed/incomplete, garbled or delayed computer transmission, which may limit a user's ability to participate. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or Website; violates the Official Rules; or acts in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor and its agencies are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability of an individual to participate in or accept a prize in the Sweepstakes, or by any human error which may occur in the processing of the Entries in this Sweepstakes. Sponsor and its agencies are not responsible for any typographical error in the printing of these Official Rules, administration of the Sweepstakes or in the announcement of the prize. Sponsor and its agencies are not responsible for damages to user's system occasioned by participating in the Sweepstakes or downloading any information to participate in the Sweepstakes. Sponsor reserves the right to modify or cancel the online portion of the Sweepstakes if it becomes technically corrupted. In such event, Sponsor would select the Grand Prize winner from among all eligible Entries received overall prior to cancellation.
  10. Dispute Resolution: By entering this Sweepstakes, Entrants agree that 1) Any and all disputes, claims, and of action arising out of or connected with the Sweepstakes (including the construction, validity, interpretation, and enforceability of these Official Rules) or the Grand Prize that cannot be resolved between the parties shall be resolved individually, without resort to any form of class action; 2) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and associated with entering the Sweepstakes and shall not include any punitive, consequential or other damages, or attorneys' fees; 3) The value of the Grand Prize as set forth above represents Sponsor's good faith determination of the ARV in its sole and absolute discretion thereof and such determinations are final and binding and cannot be appealed. If the actual value of the Grand Prize turns out to be less than the stated ARV, the difference will not be awarded in cash; and 4) Under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All dispute resolution shall be made by the Sponsor in its sole discretion. These Official Rules shall be governed by, and construed in accordance with, the laws of the state of Ohio without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the state of Ohio. Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules shall be instituted only in the federal or state courts located in the state of Ohio, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Official Rules.
  11. Severability: The invalidity, illegality, or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, such provision shall be enforced to the maximum extent permitted by law and the Sponsor's fundamental intentions hereunder, and the remaining provisions of these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein, provided, however, that in such cases the parties oblige themselves to use their best efforts to achieve the purpose of the invalid provision by a new legally valid stipulation.
  12. Privacy Policy: Any personal information that an Entrant provides in connection with the Sweepstakes shall be used by Sponsor and Administrator to administer this Sweepstakes, contact Entrants, and for the other purposes set forth in the Sponsor's privacy policy located at https://www.jamesallen.com/privacy-policy/. By entering the Sweepstakes, you agree to and accept that privacy policy. If you enter at the Website (directly or via Call-In purchase), you will be asked to consent to receive promotional emails and reminders for upcoming promotions and information about Sponsor. If Entrant consents and opts in, Sponsor may provide Entrant with information relating to products, services and promotions of the Sponsor and affiliates of Sponsor.
  13. Winner List: For the name of the Grand Prize winner, send an email to: Winners@dja.com with “James Allen Glitz & Gridiron Sweepstakes 01-2905-01 as the subject line by July 15, 2024. Winner List will be sent after the Grand Prize has been awarded.
  14. Trademark Attribution: The JAMES ALLEN trademark is the trademark of R2Net Inc.
